This Legal Disclaimer governs the use of the TG Empire website (tgempire.co.zw) and the car rental and consulting services provided by TG Empire (Private) Limited ("TG Empire", "we", "us", "our"), a company incorporated and registered in Zimbabwe. By accessing this website or using our services, you agree to the terms set out in this disclaimer.
1. General Information Only
The content published on this website is provided for general informational purposes only. While we endeavour to keep the information accurate and up to date, TG Empire makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is strictly at your own risk.
2. Website Availability
TG Empire does not warrant that this website will be available at all times or that it will be free from interruptions, errors, or viruses. We reserve the right to modify, suspend, or discontinue any part of the website at any time without notice. TG Empire shall not be liable for any loss or damage arising from temporary unavailability of the website or any service provided through it.
3. Vehicle Rental — Driver Responsibilities
3.1 Driver Eligibility
Rental vehicles may only be driven by persons who:
- Hold a valid Zimbabwe driver's licence of the appropriate class, or a valid international driving permit recognised in Zimbabwe under the Road Traffic Act [Chapter 13:11];
- Are at least 23 years of age (additional young driver surcharges may apply for drivers aged 23–25);
- Have held a licence for a minimum of 2 years;
- Are not disqualified from driving by any court order or by operation of law.
The renter is solely responsible for ensuring that all drivers of the rented vehicle meet these requirements at all times.
3.2 Traffic Laws and Fines
The renter is personally responsible for compliance with all Zimbabwe traffic laws during the rental period, including but not limited to speed limits, seatbelt requirements, prohibition of driving under the influence of alcohol or drugs, and mobile phone use restrictions, as prescribed by the Road Traffic Act [Chapter 13:11] and the Criminal Law (Codification and Reform) Act [Chapter 9:23]. Any traffic fines, toll fees, or penalties incurred during the rental period are the renter's sole liability. TG Empire reserves the right to recover such charges, plus an administration fee, from the renter's security deposit or by invoice.
3.3 Permitted Use and Prohibited Activities
Rented vehicles must not be used for any of the following without prior written consent from TG Empire:
- Transportation of goods for commercial gain (e.g., courier or delivery operations);
- Carriage of passengers for reward (including ride-hailing applications) without the appropriate public service vehicle licence under the Road Traffic Act;
- Off-road driving, track use, or driving on unsurfaced roads not suitable for the vehicle type;
- Towing of trailers, caravans, or other vehicles;
- Crossing international borders without TG Empire's written authorisation and appropriate cross-border documentation;
- Transportation of hazardous, illegal, or controlled substances;
- Any activity that is unlawful under Zimbabwe law or that voids the vehicle's insurance coverage.
4. Insurance and Liability
4.1 Third-Party Insurance
All TG Empire rental vehicles are insured for third-party liability as required by the Road Traffic Act [Chapter 13:11]. The scope of this cover is limited to third-party bodily injury and property damage as prescribed by law. It does not constitute comprehensive cover for the renter's personal liability in all circumstances.
4.2 Vehicle Damage and Excess
The renter accepts full financial responsibility for any damage to, or loss of, the rental vehicle (including theft) that occurs during the rental period, up to the value of the vehicle at the time of the loss. A damage waiver or excess reduction option may be available — please enquire at the time of booking. Damage waiver does not cover:
- Damage caused while driving under the influence of alcohol or any controlled substance;
- Damage resulting from a prohibited use as listed in clause 3.3 above;
- Damage to tyres, wheels, the undercarriage, or the roof unless caused by a collision;
- Damage caused by gross negligence or wilful misconduct.
4.3 Personal Belongings
TG Empire accepts no liability for the loss of, or damage to, personal belongings left in rental vehicles. Renters are advised to ensure their own travel or personal effects insurance covers such losses.
5. Vehicle Condition and Pre-Rental Inspection
Before taking possession of a vehicle, the renter is required to conduct a joint inspection with a TG Empire representative and sign the Vehicle Condition Report. Any pre-existing damage not noted on the report may be charged to the renter upon return. By signing the report, the renter acknowledges the condition of the vehicle at the time of collection. In the event of a dispute about damage, TG Empire's signed condition report shall be prima facie evidence of the vehicle's condition at collection.
6. Limitation of Liability
To the fullest extent permitted by the laws of Zimbabwe, including the Consumer Protection Act [Chapter 14:44]:
- TG Empire shall not be liable for any indirect, special, incidental, consequential, or punitive damages arising from the use of a rental vehicle or from any failure of the vehicle;
- TG Empire's total liability to any renter in connection with a rental transaction shall not exceed the total rental fees paid for that transaction;
- TG Empire is not liable for mechanical failure, breakdown, or loss of use during the rental period beyond providing reasonable roadside assistance where practicable.
Nothing in this disclaimer limits TG Empire's liability for death or personal injury caused by its own negligence, fraud, or any liability that cannot lawfully be excluded under Zimbabwe law.
7. Consulting Services Disclaimer
Any accounting, tax, or business consulting advice provided by TG Empire is given in good faith based on information supplied by the client and on the laws of Zimbabwe as understood at the time of the engagement. Such advice does not constitute a legal opinion and should not be relied upon as a substitute for formal legal advice from a qualified legal practitioner. TG Empire is not liable for losses arising from the client's implementation of advice without due regard to their specific circumstances or subsequent changes in law.
8. Pricing and Currency
Prices displayed on this website are indicative and may be quoted in United States Dollars (USD) or Zimbabwe Gold (ZiG) as applicable. All transactions are subject to the exchange control regulations administered by the Reserve Bank of Zimbabwe under the Exchange Control Act [Chapter 22:05]. Final pricing will be confirmed at the time of booking. TG Empire reserves the right to adjust prices without prior notice due to changes in statutory charges, fuel levies, or regulatory requirements.
9. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of TG Empire or its content suppliers and is protected under Zimbabwe's intellectual property laws, including the Copyright and Neighbouring Rights Act [Chapter 26:05]. Unauthorised reproduction, distribution, or modification of any content is prohibited without TG Empire's prior written consent.
10. Governing Law and Jurisdiction
This disclaimer, and any dispute or claim arising out of or in connection with it or TG Empire's services, shall be governed by and construed in accordance with the laws of Zimbabwe. The parties submit to the exclusive jurisdiction of the courts of Zimbabwe, with venue in Chinhoyi or Harare at TG Empire's election.
11. Severability
If any provision of this disclaimer is found to be unlawful, void, or unenforceable under Zimbabwe law, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
